1. Operational Identity

1.1 Who We Are: The Moonlight Garden Design Co. (MGDC) is a specialist digital garden design studio founded by Stuart Savage. We focus exclusively on remote design services UK nationwide.

1.2 Division Protocol: We operate independently from Stuart Savage Landscaping (the Build Division). The Moonlight Garden Design Co. provides 3D Digital Twin modelling and technical blueprints but does not offer physical construction, on-site project management, or manual site surveyance.

1.3 Formal Communication: All professional project communications must be directed to info@moonlight-studio.uk to maintain the audit trail required for the Digital Twin Pipeline.

2. Nature of Digital Services

2.1 Remote Architecture: We are a digital consultancy. We provide conceptual 3D visualisations, CAD master plans, and planting schedules based entirely on client-provided data.

2.2 No Physical Intervention: We do not perform manual groundworks, planting, or on-site inspections. Our role is to provide the "Digital Instruction Manual" for your chosen local contractor.

2.3 Sprint Methodology: Projects are executed within a 21-day design sprint. This timeframe commences only after the full submission of the Data Dossier.

3. Client Obligations (Site DNA)

3.1 Forensic Accuracy: The Client is solely responsible for the precision of the Data Dossier (Measurements, Video Walkthrough, and Photo Logs) provided via the Onboarding Portal.

3.2 Data Liability: designs are calibrated against client data. We accept no liability for design errors or construction failures resulting from inaccurate measurements. Redrawing blueprints due to incorrect site DNA submitted by the client incurs a technical fee of £120/hr.

4. Deliverables & Sprint Process

4.1 Package Scope: Deliverables are defined by the specific tier purchased (Foundation, Signature, or Blueprint). These include digital PDF plans, MP4 cinematic walkthroughs, and technical material schedules.

4.2 Revision Protocol: Signature and Blueprint paths include one (1) round of technical refinement to the draft layout. Fundamental changes to the "Primary Move" (major structural shifts) after draft approval constitute a Change of Scope and are billable.

5. Professional Fees & Refunds

5.1 Upfront Commitment: All fixed-price design suites must be paid in full at checkout to secure your slot in the Digital Twin Pipeline.

5.2 Refund Standard: A full refund is available within 14 days of purchase, provided the Creative Partnership Kit has not been submitted. Once site DNA is analysed or a strategy session is held, the service is deemed "significantly commenced" and is strictly non-refundable.

6. Intellectual Property

All 3D Digital Twins, cinematic walkthroughs, lighting schematics, and technical blueprints remain the exclusive intellectual property of The Moonlight Garden Design Co. and its founder. The Client is granted a Single-Build License for the specified property address only. Redistribution or resale of these assets is prohibited.

7. Construction Disclaimer

7.1 Contractor Responsibility: We provide the technical blueprint, but the appointed builder is responsible for on-site health and safety, service identification (CAT scanning), and Building Regulation compliance.

7.2 DPC Safety Lock: Our designs mandate a 150mm gap between paving and the house Damp Proof Course. Failure to implement this gap voids the design's structural alignment.

7.3 Verification: Contractors must verify all dimensions on-site before commencing excavation. Moonlight Studio is not liable for material shortages or wastage caused by site variance.

8. Conduct & Founder Privacy

9. Service Suspension & Incapacity

9.1 Professional Capacity: As the Lead Designer operates as a specialist practitioner, delivery is dependent on professional health and capacity. We reserve the right to defer work in the event of a documented medical emergency or incapacity.

9.2 Liability Limit: Moonlight Studio is not liable for consequential loss or damages resulting from delays caused by professional incapacity. project momentum will resume at the earliest functional window.

10. CIS Contractor Liability

Independent contractors engaged for physical builds under the Construction Industry Scheme (CIS) are solely responsible for their own workmanship. Any build errors caused by contractor negligence must be rectified at the contractor's sole expense.

11. Digital Handover Protocols

11.1 Immediate Execution: By submitting your Data Dossier, you expressly request the design sprint begin immediately, thereby waiving your right to cancel under consumer cooling-off regulations once technical analysis has commenced.

11.2 Artifact Integrity: Corrupt or damaged digital files will be replaced free of charge within 48 hours of notification.
