1.1 Who We Are: The Moonlight Garden Design Co. is a specialist digital garden design studio founded by Stuart Savage. We focus exclusively on remote design services for clients nationwide.
1.2 Relation to Stuart Savage Landscaping: We operate independently from Stuart Savage Landscaping, which provides physical landscaping services within London and the M25. The Moonlight Garden Design Co. does not offer construction services.

2. NATURE OF SERVICES
2.1 Remote Design Only: The Moonlight Garden Design Co. is a digital design consultancy. We provide conceptual designs, visualisations, and planting plans based on the Client's information.
2.2 No Physical Works: We do not undertake physical landscaping, construction, groundworks, or maintenance.
2.3 No Site Visits: Our service is conducted entirely remotely. We do not visit properties to survey or inspect grounds.
3. CLIENT OBLIGATIONS (The "Data Dossier")
3.1 Accuracy of Data: The Client is solely responsible for the accuracy of all measurements, site photos, and boundary lines provided to us.
3.2 Liability for Errors: We accept no liability for design errors resulting from incorrect measurements or misleading visual data supplied by the Client. If a design does not fit the physical space due to inaccurate Client data, redrawing fees will apply at our standard hourly rate (£120/hr).
3.3 Ownership: The Client warrants that they own the property or have obtained full permission from the owner to commission these designs.
4. DELIVERABLES & PROCESS
4.1 Scope: The specific deliverables (e.g., 2D Plan, 3D Video, Planting List) are defined by the package purchased (Foundation Review, Signature Layout, or Complete Blueprint).
4.2 Revisions: The "Signature Layout" and "Complete Blueprint" packages include one (1) round of minor revisions to the draft layout. Further revisions constitute a "Change of Scope" and will be charged additionally.
4.3 Planting Availability: Planting lists are recommendations based on horticultural suitability. We cannot guarantee stock availability at specific nurseries.
5. PAYMENT TERMS
5.1 Upfront Payment: All fixed-price packages must be paid in full before the commencement of design work.
5.2 Refunds:
Before Work Starts: A full refund is available if cancelled within 14 days of purchase, provided no design work or consultation has occurred.
After Work Starts: Once the "Data Dossier" has been analysed or the initial consultation has been held, no refunds are issued, as the service is deemed to have commenced.
6. INTELLECTUAL PROPERTY & COPYRIGHT
6.1 Ownership: All designs, drawings, 3D visualisations, and documents remain the intellectual property of The Moonlight Garden Design Co.
6.2 License: Upon full payment, we grant the Client a non-exclusive, non-transferable license to use the designs for the purpose of constructing the garden at the specified address once.
6.3 Restrictions: The Client may not resell, distribute, or use the designs for commercial purposes or other properties without our written consent.
7. LIABILITY & DISCLAIMERS
7.1 Construction Liability: We are not responsible for the workmanship, safety, or structural integrity of any construction work carried out by third-party contractors based on our plans.
7.2 Contractor Responsibilities: It is the responsibility of the appointed contractor to:
Verify all dimensions and levels on-site before construction.
Identify underground services (cables, pipes, drains).
Ensure compliance with Building Regulations and Planning Permission.
7.3 Planning Permission: Our designs do not constitute planning drawings. The Client is responsible for checking if their project requires planning permission (e.g., for fences over 2m, decking platforms, or paving in front gardens).
8. THIRD-PARTY SUPPLIERS
8.1 Recommendations: Any "Local Sourcing List" provided is for information only. We do not vet or guarantee the goods or services of third-party suppliers or nurseries.
8.2 Contracts: Any contract for physical goods or construction is strictly between the Client and the Supplier/Contractor.
9. RETURNS & CANCELLATION POLICY
9.1 Digital Products: Due to the digital nature of our deliverables (PDF plans, video files, shopping lists), items cannot be "returned" in the traditional sense. Once a final design file has been sent to the Client, the order is considered fulfilled and is strictly non-refundable.
9.2 Waiver of Cooling-Off Period: Under the Consumer Contracts Regulations, you usually have a 14-day cooling-off period. However, by submitting your "Data Dossier" or booking your consultation, you expressly request that the service begin immediately. You acknowledge that, by doing so, you lose your right to cancel once the service has been entirely performed or has been significantly commenced.
9.3 Defective Files: In the unlikely event that a digital file is corrupt, unreadable, or technically defective, we will replace or rectify the file immediately, free of charge.
10. GOVERNING LAW
These terms shall be governed by and construed in accordance with the laws of England and Wales.
